John successfully stopped an attempt by an adjacent, rival pipeline operator to obtain a right of way over their client’s property to deliver oil to a large customer, arguing that the expropriation served no public purpose and would instead stifle competition between the two pipeline operators.
After a trial on the merits, the court denied the attempted expropriation on the grounds that it would violate the Louisiana Constitution.
